			<content:encoded><![CDATA[<p>Daniel K. Printz, Esq., is returning to teach at the University of San Diego Paralegal Program in October, 2011. Daniel teaches &#8220;Estates, Wills &amp; Trusts,&#8221; the 10th of 11 classes required to complete a paralegal certification. This will be his eleventh time teaching the course, dating back to late 2007.</p>
<p>A 33-hour course, Estates, Wills &amp; Trusts covers such topics as the use of various estate planning methods and devices, including wills, trusts, durable powers of attorney, health care directives and beneficiary designations. The rules of intestate succession will be covered. Emphasis will be placed on planning tools and administration of estates.</p>
<p>The course is also designed to introduce the procedures and court proceedings required to manage probate and non-probate transfers in California. Students are required asked to prepare forms that are ordinarily required in formal California probate proceedings.</p>
<p>The course is taught Tuesday and Thursday evenings from October 6 through September 10th.</p>

			<content:encoded><![CDATA[<p>Just before I passed the bar exam in 2009 I was clerking for attorney Gayle Mayfield-Venieris, principal of <a href="http://www.mayfield-law.com">Mayfield and Associates</a> in Solana Beach, California. Gayle, a top business law and litigation attorney, offered me a truism which ran something like this: &#8220;In good times, business transactions rise and litigation decreases; in hard times, the reverse is true.&#8221;</p>
<p>It simply makes sense: while money is flush, a business would prefer to spend its resources gathering and servicing clientele then throwing good money chasing after bad. On the other hand, where there is a lack of clients and business to go around, every piece of revenue must be protected, even if it means litigation to recoup losses.</p>
<p>Of course, there are niches which thrive on the reverse: When businesses falter or fail, there is certainly transactional work to be done selling of or dismantling those businesses. Nevertheless, I&#8217;m not surprised to have notices a gradual upswing in advertising for litigation paralegals.</p>
<p>Evidence for the increasing demand for litigation paralegals can be seen in the advertisements in the <a href="http://www.sddt.com/Classifieds/index.cfm?Action=Browse&amp;Category=Employment%20Legal&amp;PublicationDate=2011-03-02">San Diego Daily Transcript</a>, which I pulled off their website today and include for you below. As a result, unemployed individuals and those collecting unemployment benefits may receive complete funding of tuition and books for the Paralegal Program.</p>
<p>Secondly, the U.S. Department of Labor has partnered with the U.S. Department of Defense to provide training funds for spouses of active duty military personnel.  These funds may cover over 80% of the tuition, and are available through the Military Spouse Career Advancement Account.</p>
